26 of February end in correctional Court 12 took the oral judgment to the colleague Raul Dargoltz yesterday. The judge gave by initiate the judgment with the reading of the demand that originates it, where consists clearly that Mr. Brevetta Rodriguez feels slandered and injuriado by the publication of the book " santiague6nazo ", and for that reason brings suit to the author since supposes publisher to it - distributing of the same one. Not is certainty of all declared there because in these judgments single a act is made in the end, which did me to think like historian, that important it is that in Manifesto of HaD we declare those in favor of new erudition that it extends concept of source historical, because although all we know the benefit that can be managed to study judicial sources, in this case the single Argentine law will leave like certainty a act, that somebody will make according to his to understand, and giving its particular slant him, and a sentence that the idea of the judge when dictating it will explain, but that will not allow us to accede to the protagonists. Ayer 26 de febrero se llevó cabo en el Juzgado correccional 12 el juicio oral al colega Raúl Dargoltz. Cabe destacar la presencia del Dr. Mariano Rodriguez Otero de la Facultad de Filosofía y Letras de la U.B.A , entre otros amigos , que no pudieron presenciar el juicio, que según nuestra ley es público, ya que el juez Raúl García solo autorizó el ingreso de un historiador por escasez de espacio y me honraron con esa distinción. Mi insistencia en presenciarlo constituye, de acuerdo con Raúl por supuesto, una representación simbólica de todos los colegas que desde las distintas latitudes han acompañado a Dargoltz.El juicio se inició a las 10 horas de Argentina aproximadamente y la instancia llevada a cabo ayer duró hasta las 14.30 horas, ya que se dejaron los alegatos finales de cada una de las partes para el día de hoy, por pedido de la parte querellante. El juez dio por iniciado el juicio con la lectura de la demanda que lo origina , donde consta claramente que el Sr. Brevetta Rodríguez se siente calumniado e injuriado por la publicación del libro "El santiagueñazo" , y por ello entabla demanda al autor ya que lo supone editor - distribuidor del mismo . No queda constancia de todo lo declarado allí porque en estos juicios solo se realiza un acta al final, lo cual me hizo pensar como historiadora, que importante es que en el Manifiesto de HaD nos manifestemos partidarios de una nueva erudición que amplíe el concepto de fuente histórica, porque si bien todos sabemos el provecho que puede lograrse de estudiar fuentes judiciales, en este caso la ley argentina solo nos dejará como constancia un acta ,que alguien fabricará según su entender, y dándole su particular sesgo, y una sentencia que explicará la idea del juez al dictarla , pero que no nos permitirá acceder a los protagonistas. El querellante Brevetta Rodríguez, decidió no declarar, en cambio Raúl Dargoltz si ofreció un amplio alegato, aportando en cada momento la fuente de donde tomó el dato para la construcción de su obra, que a mi realmente me enorgulleció, porque demuestra la seriedad con que nuestro colega ha trabajado, de la cual jamás tuve duda alguna, pero que no permite, mas allá del resultado del juicio, mostrar ningún punto débil.Todos sabemos que aquí se juega mucho más que una cuestión judicial, está en litigio nada menos que el derecho de publicar una obra de Historia Inmediata. Si callan a Raúl , en la Argentina nos habrán callado a todos. Esperemos que esto no ocurra .Y más allá de cual sea el final de esto, por lo menos nos quedará la satisfacción de haber luchado para impedirlo y la inmensa alegría de no haber estado solos nunca.Siguiendo con el proceso, luego de Raúl se presentan sus testigos la otra parte no presentó a nadie. Los testigos, tres hombres santiagueños, me hicieron y me hacen sentir orgullo por ser argentina, ya que no solo prestaron testimonio sobre la circunstancias en que fueron entrevistados por Raúl para el libro, sino que describieron, sin ser historiadores, la mas rigurosa metodología que para trabajar con historia oral existe y además trajeron a esa sala nuevamente el fragor de aquellos hechos que permitían intuir el marasmo social que hoy conmueve a la Argentina porque cada cada uno de ellos fue protagonista activo de aquella memorable jornada, donde harto el pueblo de nuestra provincia mediterránea dijo basta a la corrupción y se manifestó. Pasaron por allí y en sus relatos elementos que podrían nutrir, metodológicamente trabajados, biografías, microhistoria y macrohistoria , historia de la educación, etc. Reconozco que fue una experiencia fascinante. Los testigos fueron y son luchadores por una Argentina distinta, hombres comprometidos, humildes, a quienes desplazarse hasta Bs.As. distante a 1200 Km. no les ha sido fácil, sobre todo porque tampoco nuestro "acusado amigo" tiene una situación económica brillante, lo que que hace mucho mas loable este esfuerzo por la verdad y la justicia.Dos de los testigos fueron preguntados por el Juez si creían en la Justicia, y ambos contestaron que obviamente no creían en la de su provincia que estaban en poder de gente como el querellante.El Juez se interesó luego por si creían en la justicia nacional (que como todos saben está altamente cuestionada por aquí) y ellos , con la simpleza de palabras que caracteriza nuestro hombre del interior del país le contestaron que esperarían para opinar.Hoy por la mañana se están llevando a cabo los alegatos finales y luego el Juez dijo que se tomará una semana para dictar sentencia. Deberemos pues esperar este resultado, pero mas allá de él creo sinceramente que la actuación de Raúl Dargoltz, sus abogados y sus testigos permite creer en un país mejor, donde el compromiso y la solidaridad puedan al fin asomar la nariz entre tanta corrupción.Deseo destacar que la parte querellante adjuntó como intento de presionar al Juez una publicación realizada en Santiago del Estero, donde aparecía nuestra adhesión como integrantes de HaD, pero como justo Raúl adjuntó todas las firmas que llegaron y yo me identifiqué como miembro de HaD, si querían con esto hacer ver una maniobra y una falsedad de Raúl, se les dio vuelta.
